In these Terms, "we," "us," or "our" refers to Elite NRIs Club.

By accessing or using our platform, whether as a registered member or a visitor, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, you must discontinue use of the platform immediately.

We reserve the right to modify or update these Terms at any time. Any revisions will be posted on our website, and the date of the latest update will be indicated. It is your responsibility to review the Terms periodically.

For registered members, we will make reasonable efforts to notify you of any significant changes via the contact details provided in your account.

2.1 Age Requirement

• You must be at least 18 years old to register or use the Elite NRIs Club platform.
• If you are under 18, you are not permitted to register or access our services.

2.2 Accurate and Updated Information

• You agree to provide accurate, complete, and current information during registration and to promptly update any changes.
• Providing false or misleading details may result in suspension or termination of your account.

2.3 Marital Status Disclosure

• You must truthfully declare your marital status (single, divorced, or separated).
• If applicable, you may be required to provide proof of eligibility to marry as per the laws of your country of residence.

2.4 Single Profile Policy

• Each individual is permitted to create only one personal profile.
• Duplicate or multiple accounts are strictly prohibited and may be deleted without notice.

2.5 Parent or Family Member Accounts

• If a parent or family member creates an account on behalf of a user, they must obtain the explicit consent of that user.
• Elite NRIs Club is not liable for any accounts created without such authorization.

2.6 Responsibility for Communication

• Users are responsible for checking messages and notifications within the platform.
• Elite NRIs Club does not send separate reminders to paid or free members.
• Communication through the platform is considered official and valid.

3.1 Account Responsibility

• You are responsible for all activities that occur under your account.
• You must promptly notify us of any unauthorized use or suspected breach of security.

3.2 Account Credentials

• Your login credentials (email, password, or verification codes) are personal and non-transferable.
• You agree to maintain their confidentiality and not share them with any third party.

Elite NRIs Club provides:

• Verified matchmaking services.
• Profile creation and compatibility tools.
• Curated introductions and premium concierge matchmaking (where applicable).

Important Disclaimer: Elite NRIs Club does not guarantee successful matches, marriages, or specific outcomes. We only provide a verified, secure introduction platform.

5.1 Membership Fees

• Membership fees and subscription tiers are listed on the Upgrade Membership page.
• Fees may vary by country due to exchange rates, taxes, and market conditions.
• All prices are billed in USD, unless stated otherwise.

5.2 Free Trials & Promotions

• Promotional offers must be redeemed within their stated timeframes.

5.3 Auto-Renewals

• Subscriptions automatically renew unless canceled at least 48 hours before the next billing cycle.
• Cancellations can be made via account settings or by emailing support@elitenrisclub.com.

5.4 Refund Policy

• Membership fees are non-refundable once payment is processed.
• Refunds will only be issued for duplicate charges or technical billing errors.
• Refund requests must be submitted within 7 days of the charge to support@elitenrisclub.com.
• By using the Platform, you agree not to initiate chargebacks without contacting our support team first.

5.5 Payment Responsibility

• You are responsible for maintaining a valid payment method and ensuring timely subscription payments.

• Membership fees are clearly stated at the time of purchase
• Subscriptions do not auto-renew unless explicitly stated
• Promotional pricing is subject to change without notice
• All payments are processed securely through our payment partners

6.1 Mandatory Verification

• All members are required to complete ID and selfie verification to gain access to the platform.
• Failure to finish the verification process may lead to account suspension or termination.

6.2 Consent to Data Collection

By submitting your ID and selfie, you consent to:

• Secure collection and encrypted storage of your data for identity verification purposes only.
• Strictly limited access by authorized personnel.
• Storage on secure servers located in Canada, compliant with PIPEDA, GDPR, and other global privacy laws.

Data Retention

• Verification data will be automatically deleted after 90 days, unless it is required to prevent fraud or comply with legal obligations.
• Users may request immediate and permanent deletion by emailing legal@elitenrisclub.com.

6.3 Fraud Prevention & Law Enforcement Cooperation

• Submitting fraudulent IDs or attempting to bypass verification will lead to immediate termination.
• Elite NRIs Club may report such activity to local and international law enforcement authorities.
• Relevant data may be shared with authorities for investigations into fraud or cybercrime.

7.1 User Responsibility

You are solely responsible for all content you upload, including:

• Profile information
• Photos and video
• Messages and communications

7.2 Prohibited Content

You may not upload, or share content that is:

• False, misleading, or fraudulent
• Harassing, abusive, obscene, or discriminatory
• Explicit, pornographic, or otherwise inappropriate
• Related to scams, extortion, or solicitation of money

7.3 Prohibited Activities

Strictly prohibited behaviors include:

• Misrepresenting identity, marital status, or intentions
• Harassing, threatening, or blackmailing other members
• Creating fake profiles or scamming others
• Soliciting payments outside the platform
• Uploading explicit or illegal content
• Violating any cyber laws, including but not limited to:
  • – GDPR (EU)
  • – CCPA (USA)
  • – PIPEDA (Canada)
  • – Information Technology Act (India)
  • – Other local laws in your jurisdiction

7.4 Offline Meetings Disclaimer

• Elite NRIs Club does not conduct criminal background checks or verify the personal history of members.
• Users meet at their own risk and are responsible for taking safety precautions.
• Always meet in public places and inform family or friends beforehand.
• We are not liable for any incidents, disputes, or damages resulting from offline meetings.

7.5 Indemnification

• You agree to indemnify and hold Elite NRIs Club harmless against any claims, damages, or expenses resulting from your actions, content, or use of the Platform.

8.1 Our Rights

We may suspend or terminate accounts immediately, without refund, if a member:

• Provides false information or fraudulent IDs
• Harasses, scams, or abuses other members
• Violates these Terms or applicable laws
• Non-payment of subscription fees

8.2 User Rights

• You may deactivate or delete your account at any time by contacting support.
• Membership fees remain non-refundable.

8.3 Reinstatement of Services

• Reinstatement after suspension is at the company's discretion and may require additional verification or fees.

8.4 Inactive or Unverified Accounts

• Unverified or inactive accounts may be removed to maintain quality and safety.

• All data is processed under our Privacy Policy.
• Elite NRIs Club complies with:
  • PIPEDA (Canada)
  • GDPR (European Union)
  • CCPA/CPRA (California, USA)
  • Other applicable regional privacy laws

Absolute security cannot be guaranteed despite industry-standard encryption measures.

10.1 Ownership of Content

• All trademarks, logos, designs, software, text, graphics, and other content on the Platform are the exclusive intellectual property of Elite NRIs Club or its licensors and are protected by Canadian and international copyright, trademark, and intellectual property laws.

10.2 Limited License to Members

• Members are granted a personal, non-exclusive, non-transferable license to access and use the Platform solely for the purpose of matchmaking and related services.
• This license does not permit:
  • Copying, reproducing, or distributing Platform content
  • Reverse-engineering, decompiling, or tampering with the Platform's code
  • Using the Platform for any commercial purpose without written consent

10.3 User-Generated Content

• Users retain ownership of the content they upload, such as profile information, photos, and messages.
• By uploading content, you grant Elite NRIs Club a worldwide, royalty-free license to use, display, and process that content solely for matchmaking and platform operation purposes.
• You represent and warrant that you have the necessary rights and permissions to upload such content.

10.4 Prohibited Use of IP

• Unauthorized use of Elite NRIs Club's intellectual property or the intellectual property of other members is strictly prohibited and may result in immediate termination of your account and potential legal action.

10.5 Profile Promotion & Social Media Display

• By creating a profile on Elite NRIs Club, members agree that limited profile information, including profile ID, age, profession, location, education details, and profile photographs (where permitted by the member), may be displayed on the platform, affiliated social media pages, advertisements, or matchmaking groups for matrimonial and promotional purposes.
• Elite NRIs Club does not publicly display sensitive personal information such as phone numbers, email addresses, residential addresses, or government identification details without explicit consent.
• Female member photographs may remain private based on profile privacy settings and platform policies. Members may request removal or modification of promotional content by contacting support@elitenrisclub.com.

11.1 Service Provided "As Is"

Elite NRIs Club provides its services "as is", without any warranties, guarantees, or representations of any kind, whether express or implied.

11.2 No Responsibility for Certain Issues

We are not responsible for:

• Misrepresentation or false information provided by members.
• Failed matches, marriages, or relationships.
• Immigration, visa, or legal issues arising from relationships.
• Technical failures, server outages, or service interruptions.
• Losses or damages resulting from unauthorized account access.
• Cyberattacks, data breaches, or events beyond our reasonable control.
• Third-party service providers, such as payment processors or hosting platforms.

11.3 Maximum Liability

Our total liability, whether in contract, tort, or otherwise, is strictly limited to the membership fees you paid in the last 12 months preceding the claim.

12.1 Governing Law

• These Terms, and any dispute arising out of or relating to them, are governed exclusively by the laws of Ontario, Canada, without regard to conflict of law principles. All services are deemed to be provided from Canada, regardless of the member's location.

12.2 Jurisdiction

International members acknowledge and agree that:

• Any disputes, claims, or actions shall only be resolved under Canadian law.
• Unless mandatory local consumer protection laws require otherwise, in which case those laws will apply only to the minimum extent required by law.
• Elite NRIs Club is not subject to the jurisdiction of foreign courts unless required by a binding international treaty or Canadian law.

12.3 Binding Arbitration (Mandatory)

Any dispute, claim, or controversy relating to these Terms or the Platform shall be resolved exclusively through binding arbitration, not in court.

Arbitration will be conducted:

• In English
• Virtually (online) or in Ontario, Canada
• Under the rules of either:
  • The ADR Institute of Canada (ADRIC), or
  • The International Chamber of Commerce (ICC) for international disputes.

12.4 Class-Action Waiver

• To the maximum extent permitted by law, members agree that disputes must be resolved individually, and no member may join or participate in a class-action, group claim, or collective proceeding against Elite NRIs Club, its officers, directors, employees, or affiliates.

12.5 Limitation of Claims

• Any claim or dispute must be filed within one (1) year from the date the cause of action arose. Claims filed after this period are permanently barred.

12.6 Protection of Officers & Directors

• Members agree that no officer, director, founder, employee, or contractor of Elite NRIs Club, including the CEO, can be personally held liable for any claim or damages. All legal responsibility rests solely with the corporate entity.

Elite NRIs Club welcomes members of all genders equally.

We do not promote or discriminate based on:

• Gender
• Visa status
• Financial or social status
• Family situation (e.g., with or without children)

Partner preferences expressed by members are their personal choice, and the platform is not responsible for content reflecting those preferences.

• Members must comply with all relevant cybercrime and data privacy laws.
• Elite NRIs Club may report unlawful activities to local or international authorities.
• Cooperation with law enforcement will occur as required by law.
